What are the EB5 Visa Investment Options?

The EB-5 investor visa program enables foreigners who make an investment in the U.S. business to obtain a green card. If you have enough capital and would like to enjoy all benefits of the U.S. permanent resident, this can be great opportunity for you.

EB-5 program offers several investment options and you can invest in any type of for-profit lawful business entity in the following categories:

1.     New Business

a.     Creating a new business

You can invest the required amount of capital, which is $1,000,000, in a commercial enterprise that was established after November 29, 1990.  However, the limit is reduced to $500,000 in case you invest to targeted employment areas with the unemployment rate 150% of the national average.

b.     Restructuring or reorganizing an existing business

Enterprises established before November 29, 1990, can also be considered as new businesses if they have gone through reorganization or substantial change. Good example is changing night club to restaurant.

c.     Expanding an existing business

You can either expand the net worth of an existing business or the number of employees by 40%. If you choose the latter, you are required to create more than 10 jobs.

d.     Pooling

If you have friends who would like to invest as well, you can do it together and put required amount into an enterprise and create at least 10 jobs each. All jobs created by a pooling arrangement will be distributed evenly among investors.

2.     Troubled Business

Another option is investing in the enterprise that has existed for a minimum of 2 years and has incurred a net loss for the 12 to 24 month period before you file Form I-526. This loss must be equal to at least 20 % of the business’s total net worth. But remember, for at least two years, the business must maintain the same number of jobs that existed before you invested in the company.

3.     Regional Center

If you don’t want to participate in management of the business where you invest then regional centers are the best option for you. They are government-approved entities in designated geographical areas for which USCIS has determined that investments will create the necessary ten jobs per investor, whether directly or indirectly. USCIS sets aside 3,000 visas per year for people who invest in a designated Regional Center Program.

As you can see, the EB-5 visa is a good way to get your green card and permanent residency through investment.
